1. Organizer
The organizer of this sales promotion is KTM Sportmotorcycle GmbH, Stallhofnerstraße 3, 5230 Mattighofen, Austria (hereinafter "KTM"). More information about KTM is available at www.ktm.com.
2. Eligibility
Participation is open to natural persons aged 18 years or older who are legally resident in countries where such promotions are permitted by law. Participants must purchase a brand-new 2025 KTM EXC motorcycle from an official, approved KTM dealership during the promotional period. Employees of KTM, its affiliated companies, participating partners, agents, their immediate family members, and anyone professionally involved in this promotion are excluded from participation.
PARTICIPATING RULES: Participants whose personal details are not true will be excluded from participation. Likewise, participants who attempt to manipulate or attempt to manipulate the participation process and / or the competition and / or otherwise violate the terms and conditions of participation will be excluded. Employees of the organizer, the subsidiaries and affiliated companies of the organizer as well as employees of companies participating in the competition as well as their relatives are excluded from participation in the competition. The exclusion can also be done retrospectively, and any prize already given in this case can be reclaimed.
3. Promotion Period
The promotion runs from April 16, 2025, until May 15, 2025 (23:59 CET).
4. Entry Requirements
To enter, participants must purchase a new 2025 KTM EXC motorcycle from an official KTM dealership during the promotional period. Each eligible purchase will result in automatic entry into the prize draw. No additional registration is required.
KTM reserves the right to request proof of purchase and/or dealership documentation to confirm eligibility.
Participants whose personal details are found to be inaccurate, incomplete, or misleading will be excluded. Any attempt to manipulate the promotion or breach the terms and conditions may result in disqualification.
5. Prizes & Winner Selection
Three (3) winners will be randomly selected from all valid entries after the promotional period ends. Each winner will receive:

Accommodation details:
Each winner will receive 1 (one) apartment for the duration of the event, with sufficient space to accommodate two people. Please note that it cannot be guaranteed that the apartment will include two separate bedrooms or two separate beds.
Availability disclaimer:
KTM will make every reasonable effort to facilitate the Private Erzberg Tour, Meet & Greet, and Exclusive KTM Racing Truck Tour. However, these elements are subject to the availability of the riders and team schedules. In the event of unforeseen circumstances, including but not limited to time constraints, illness, or race obligations, KTM cannot guarantee the execution of one or more of these activities. KTM shall not be held liable if any portion of these activities is modified, rescheduled, or canceled.
The winners will be notified via the contact details provided at the time of purchase. If a selected winner cannot be reached within five (5) calendar days of notification, or fails to confirm acceptance, a replacement winner may be drawn.
Prizes are non-transferable and no cash alternative or substitution will be provided. KTM is not responsible for any personal taxes, travel costs, or other incidental expenses related to the prize unless explicitly stated.
6. Early Termination or Modification
KTM reserves the right to cancel, amend, or terminate the promotion at any time without prior notice, if technical, legal, or other circumstances prevent its proper execution. No legal claims may be derived from this.
7. Data Protection (GDPR)
Personal data will be processed by KTM solely for the purpose of managing the promotion and contacting winners, in accordance with the EU General Data Protection Regulation (GDPR).

A revocation of consent does not apply retroactively to previous processing, including entries already submitted or winners already selected.
8. Media Rights
By accepting the prize, winners agree to participate in photo and video documentation during the Erzbergrodeo event. These materials may be used by KTM and affiliated partners for promotional and marketing purposes, including social media and websites, without additional compensation. This consent can be revoked in writing at any time, effective for future use.
9. Liability
KTM is liable only for intentional or grossly negligent breaches of duty. For minor negligence, KTM is only liable for the breach of essential contractual obligations (cardinal duties), and in such cases, liability is limited to foreseeable damages. This does not affect liability for injury to life, body, or health.
10. Miscellaneous
This promotion is not affiliated with Instagram, Facebook, or any other social media platform. KTM assumes no liability for platform-related issues or outages.
The promotion is governed by Austrian law, with the exclusion of conflict of law rules. The right of legal recourse is excluded.
If any provision in these terms is or becomes invalid, the remaining provisions remain unaffected and in full force.
11. Legal Eligibility by Country
This promotion is open only to participants residing in countries where such sales promotions, prize giveaways, or sweepstakes are legally permitted. It is the sole responsibility of the participant to ensure that participation in this promotion does not violate any local laws or regulations applicable in their country of residence.
KTM expressly disclaims any responsibility or liability in the event a participant takes part in this promotion from a country where such participation is prohibited or restricted by law. By entering, participants confirm that their participation is legally compliant with the laws of their jurisdiction.
Countries where participation is generally permitted include, but are not limited to, members of the European Union (subject to local variations), United Kingdom, Norway, and Switzerland. Participants from other regions are advised to consult their local laws or authorities before entering.
KTM reserves the right to exclude entries from jurisdictions where the promotion is not legally permitted or to disqualify winners found to have participated from such regions.
